Can I sue my toothpaste company for the erosion that occurred from using their whitening toothpaste?

I used a particular brand of whitening toothpaste for a few months and now my enamel is damaged and my teeth are eroding at an unhealthily rapid pace for my age (21). This toothpaste advertised that the formula was strong (waaaay too strong in actuality), but safe (which it wasn%26#039;t). If I got proof from my dentist that the erosion ocurred all of the sudden and at an unusually rapid pace for my age, would I have grounds for a legal suit? The problem is, I don%26#039;t have proof that I used that particlar toothpaste for the said amount of time. Do I have anything to build a case with?

You are exactly the problem America has right now. It%26#039;s lazy people like you that we need to get rid of that think they can get a couple extra bucks by sueing big corporations. You get in a car accident that YOU caused, so you sue Ford for an unsafe car. You get fat, so you sue McDonalds for making you fat!!! You trip on some ice in a Wal-Mart parking lot because you weren%26#039;t paying attention, so you SUE THEM!!!! PLEASE GOD DO NOT SUE THEM!! You even state yourself that you do not have proof. God, I hope you get a conservative judge.

Reply:Talk to an attorney. I%26#039;d personally like to know if a whitening toothpaste is dangerous. Those are the kind of products that shouldn%26#039;t be on the market-or should have appropriate warnings.

Now if you were to have that particular toothpaste and could prove that you used it you may have a case.


You could have the toothpaste analized by a lab to see if it is toxic and if it is then you might be able to make them remove it from the market place.


Other than that No you don%26#039;t have a case without the proof than you used their product.
